What Goes Wrong With NYC Boilers

New York City has a large stock of pre-war buildings running one-pipe and two-pipe steam heating systems. These systems are old. Repairs take time. Parts are not always available off the shelf. When something fails mid-season, there is no waiting around for a fix.

NYC Heating Law and What It Means for Building Owners

NYC Local Law 81 requires landlords to provide heat from October 1 through May 31 each year.

The specific requirements:

  1. 6am to 10pm: if the outside temperature drops below 55 degrees F, indoor temperatures must be at least 68 degrees F
  2. 10pm to 6am: indoor temperatures must be at least 62 degrees F regardless of outside conditions
  3. Hot water must be maintained at a minimum of 120 degrees F year-round

Fines for violations start at $250 to $500 per day for an initial violation. A repeat violation in the same or following heating season goes up to $500 to $1,000 per day, with a minimum penalty of $1,000 plus $25 per day while the violation continues.

A broken boiler is not a defense against those fines. The obligation is to provide heat. A rental boiler is one of the few options that gets heat back on fast enough to matter.
